GENERAL WAIVER AND RELEASE AGREEMENT
This Agreement is for ALL Christus Ministries activities during the calendar year. This document affects your legal rights. Please read carefully before agreeing to the terms and conditions.
1. Waiver: In consideration for being allowed to participate in CHRISTUS MINISTRIES activities (collectively, “Activity”), I, for myself, heirs, representatives and assigns, release from liability and waive my right to sue CHRISTUS MINISTRIES, its employees, officers, volunteers and agents (collectively, “Organization”) from any and all claims, including claims of the Organization’s negligence, resulting in any physical injury, death, illness or economic loss I may suffer or which may result from my participation in the Activity, travel to and from the Activity (including air travel), or any events incidental to the Activity.
2. Assumption of Risks: I understand, acknowledge and accept that attending and participating in the Activity carries with it inherent risks that cannot be completely eliminated regardless of the care taken to avoid injury. The risks vary and could include personal injury (physical and/or psychological), death, damage to personal property or economic loss. Injuries may arise from my own or others’ actions, inactions, or negligence, or the condition of the Activity locations or facilities. Nevertheless, I willingly and voluntarily choose to participate in the Activity in spite of these acknowledged risks and assume all risk of injury, loss of life, and loss of or damage to property arising from my participation in the Activity, including travel to and from the Activity (including air travel) or any events incidental to the Activity.
3. Indemnification: I also agree to fully indemnify, defend and hold harmless the Organization from any and all claims, demands, causes of actions, expenses, damages or liabilities, including attorney’s fees, which may be made or brought against the Organization by any individual for damages, injuries or losses of any kind arising out of my participation in the Activity.
4. Medical Consent: I represent that I have comprehensive medical insurance that would cover any injuries incurred from participating in the Activity. If I need medical treatment as a result of my participation in the Activity, travel to and from the Activity (including air travel), or any events incidental to this Activity, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware that the Organization does not provide health insurance for me and that I should carry my own health insurance.
5. Publicity Consent: I agree and consent to my name, image, photograph, video, voice or likeness being recorded, captured, or used by the Organization for publicity and promotional purposes.
6. Severability: I further agree that this General Waiver and Release Agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid the remaining portions will continue to have full legal force and effect.
7. Acknowledgment of Understanding: I have carefully read this General Waiver and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I confirm that I am signing the agreement freely and voluntarily and intend my checked box on my online registration form to be a complete and unconditional release of all liability to the maximum extent allowed by law.
Minor Participant (if applicable): I, the parent/legal guardian of the Participant, hereby agree to the above on behalf of the Participant.
